Reserves Act 1977

Duty (as administering body) to give requisite public notification of intention to pass a resolution re exchange of reserves for other land; and to forward copy of Council's resolution together with the information specified to the Commissioner.

Duty (as administering body) to hold land so acquired as a reserve/part of an existing reserve subject to the same control/management that land given as exchange was held.

Powers (as administering body) to do everything necessary to give effect to the exchange.







Duty (as administering body) to hold and administer a reserve for the purposes specified in the resolution of Council.

Duty (as administering body) to administer recreation, historic, scenic, nature, scientific, government purpose, local purpose reserves in accordance with the principles set out; powers in relation to preservation of flora and fauna and the natural environment.

Duty (as administering body) to publicly notify proposed change to purpose/classification of a reserve;

Duty (as administering body) to forward copy of the resolution/objections specified to the Commissioner.



Duty (as local authority) where classification or purpose changed to hold land and administer reserve for that changed purpose.

Powers and duties (as administering body) re the preservation/cutting/destruction of trees and bush on the reserves specified.

Power (as administering body) to consent to use reserve/structure situated on reserve for the purposes and subject to the conditions specified.

NB: This power has been delegated to the Council by the Minister under the Instrument of Delegation; consent of the Minister is not required.

Power (as administering body) to give or decline to give consent to authorise any voluntary organisation or educational institution to erect shelters, huts etc (for a period not exceeding 5 years) on any recreation or scenic reserve.

NB: This power has been delegated to the Council by the Minister as per the Instrument of Delegation; approval of the Minister is not required.

Restrictions:

Powers and duties (as administering body) to give or decline to give consent to licences for the erection of shelters, huts, form tracks, etc on any reserve vested in it(for a period not exceeding 5 years) for/in connection with communications stations.

Duties (as administering body) before granting of a licence that is not in conformity with a management plan to give requisite public notice.

NB: This power has been delegated to the Council by the Minister under the Instrument of Delegation; consent of the Minister is not required.

Restrictions:

Powers and duties (as administering body) re granting/declining right to take flora/fauna, rock minerals/soil for scientific or educational purposes. 

Restriction:  The power under s49 as delegated under the Instrument is subject to the limitations set out in the Schedule to the Instrument (delegation re fauna relates only to exotic fauna that  are not protected under the Wildlife Act 1953) and cannot be sub-delegated.

Powers and duties (as administering body) re authorising/declining to authorise the taking and killing of exotic fauna from a scenic/ historic/nature/scientific and re the use firearms/traps, etc for that purpose.

Powers (as administering body) to authorise/decline to authorise the introduction of indigenous or exotic flora/fauna/into any scenic reserve subject for the purposes specified.

Powers and duties (as administering body) in relation to recreation reserves as specified subject to obtaining the consent of the Minister where provided and the restrictions set out below.

Restrictions: 

a.  Power to enter into an agreement for use of a reserve is limited to a period not exceeding 5 years.

b.  Subject also to General Delegations - Property Management

c.  The powers set out in s53(1)(d)-(e), (h)-(k) & (m) and the fixing of charges are not delegated.

Power (as administering body) to appoint officers/servants.

Powers and duties (as administering body) in relation to recreation reserves, to grant or decline to grant/vary/amend/ leases or licences (for a period not exceeding 5 years) subject to specified conditions/requirements.

NB: The powers under s54(1) have been delegated to the Council by the Minister under the Instrument of Delegation; consent of the Minister in that regard is not required.

Restrictions:

a.  Subject also to General Delegations - Property Management

b.  The power under s54(1) as delegated under the Instrument cannot be sub-delegated


Powers and duties (as administering body) in relation to scenic reserves as specified. 

Restrictions:

a.  The powers set out in s55(2)(d) & (g) and those relating to the erection of permanent structures are not delegated.

b.  The powers under s55(2)(a),(e)&(f) as delegated under the Instrument cannot be sub-delegated

Powers and duties (as administering body) in relation to scenic reserves, to grant or decline to grant/vary/amend/ leases or licences (for a period not exceeding 5 years) subject to specified conditions/requirements.

NB: This power has been delegated to the Council by the Minister under the Instrument of Delegation; consent of the Minister is not required.

Restrictions:

b.  The powers under s56(1)-(2) as delegated under the Instrument cannot be sub-delegated 

Powers and duties (as administering body), in respect of nature reserves, where authorised by the Minister as applicable, subject to the restrictions set out below.

Restriction: Powers under section 57(9)(a) are not delegated.

Power (as administering body) to appoint officers/servants.

Powers and duties (as administering body), in respect of historic reserves to do such other things as necessary for the proper management of the reserve.

Restrictions: The powers under section 58(b)-(c) are not delegated.

Power (as administering body) to appoint officers/servants/rangers.

Restrictions: 

The powers under section 58(b)-(c) are not delegated.

Powers and duties (as administering body) in relation to historic reserves, to grant or decline to grant/vary/amend/ leases or licences (for a period not exceeding 5 years) subject to specified conditions/requirements/exceptions.

NB: This power has been delegated to the Council by the Minister under the Instrument of Delegation consent of the Minister is not required.

Restrictions:

a.  Subject also to General Delegations - Property Management

b.  The power under 58A(1) as delegated under the Instrument cannot be sub-delegated 

Powers and duties (as administering body)in relation to scientific reserves subject to first being authorised by with Minister where specified.

Power to appoint officers, servants and rangers for the purposes of exercising function under this section.

Power (as administering body), in relation to reserves controlled or managed by an administering body under s28 of the Act, to grant or refuse to grant a concession (for a period not exceeding 5 years).

Restrictions:

a.  Subject also to General Delegations - Property Management

b.  The power under s59A(1) as delegated under the Instrument cannot be sub-delegated

Powers (as administering body), in relation to local purpose reserves, to do such things necessary for the proper administration, management, and control of the reserve and for the purposes specified in its classification;

Power (as administering body), in relation to local purpose reserves vested in the administering body, to lease a reserve (for a period not exceeding 5 years) for the purposes specified.

Power (as administering body) to consent to or decline to lease the whole or part of a recreation reserve set apart for racecourse purposes to a racing club (for a period not exceeding 5 years).

NB: This power has been delegated to the Council by the Minister under the Instrument of Delegation ; consent of the Minister is not required.

Restrictions: 

a.  Subject also to General Delegations - Property Management

b.  The power under s67(1)(b) as delegated under the Instrument cannot be sub-delegated

Power (as administering body that is a local authority), to farm or graze a recreation or local purpose reserve in the circumstances described.

Power (as administering body) to enter into an agreement or lease for farming or grazing operations by another person on a recreation or local purpose reserve (for a period not exceeding 5 years).

Restriction: The power under s 72(1) as delegated under the Instrument of Delegation cannot be sub-delegated.

Powers and duties (as administering body) to grant or decline to grant a lease (for a period not exceeding 5 years) in respect of recreation reserves vested in it for farming/grazing/afforestation purposes.

Powers and duties (as administering body) to grant leases (for a period not exceeding 5 years) in circumstances where a reserve vested in it is not being used for the purposes of a recreation reserve and to consent or decline to consent to the surrender of such leases.

NB: These power has been delegated to the Council under the Instrument of Delegation; consent of the Minister is not required.

Restrictions:

b.  The powers under s73(1)-(3) & (5) -(6) as delegated under the Instrument are subject to the limitations set out in the Schedule to the Instrument and cannot be sub-delegated 

Powers and duties (as administering body) in respect of granting of licences (for a period not exceeding 5 years) to occupy any recreation, historic, scenic, scientific, government purpose, or local purpose reserve the purposes specified.

NB: The power to grant licences for historic, scenic or scientific purposes has been delegated to the Council under the Instrument; the consent of the Minister is not required.

Restrictions:

a.  Subject also to General Delegations - Property Management

b.  The powers under s74(1)(b)(ii) as delegated under the Instrument cannot be sub-delegated

Before entering into any contract for afforestation: duty (as administering body) to give public notice as specified

Power (as administering body) to lay an information in respect of any offence against the Act within the time limit specified.

Powers and duties (as administering body) with regard to covenants and conditions of leases and licences for a period not exceeding 5 years.

Powers and duties (as administering body) to vary covenants, terms and conditions in leases and licences re the reserves specified for a period not exceeding 5 years.

Powers and duties (as administering body) re refusing/ granting consent to the transfer, sublease, etc of a lessee’s or licensee’s interest re the reserves specified.

Power  to appoint rangers and sign warrant of appointment.

Power to interfere to prevent breach.



File charging documents (note requirement to be in name of authorised person).

Powers and duties (as local authority) to enter into conservation covenants with a private landowner to protect and manage private land for the purposes of conservation as specified; and do all things necessary to effect registration of the instrument

Power to prohibit access to the whole or any specified part of a local purpose reserve.

Power to authorise actions.

Require removal of animal.

Power to issue infringement notices.

Powers in relation to trespassing animals.

Authorise fires.
