Local Electoral Act 2001

The powers and duties delegated are those of the council as a “local authority” or “territorial authority” as specified. The Council has a duty under section 12 of the Act to appoint an electoral officer. This duty is not delegated.

s4 Duty (as local authority) to take into account the principles specified as applicable and practicable. 
s19L Duty (as territorial authority) to send copies of resolutions re community boards and representation arrangements for elections of territorial authorities to specified persons and organisations. 
ss19M - 19N Duties (as territorial authority) re giving public notice of proposals and responsibilities in relation to submissions, etc.


s19Q Duty (as territorial authority) to forward appeals and objections, together with necessary information, to the Commission.


s19X Duty (as territorial authority) to supply the Government Statistician with such information as may be required. 
s19Y Duty (as territorial authority) to give public notice of basis for election;

Duty to reimburse the Commission for certain costs incurred;

Duty to keep a copy of every determination available for inspection as provided.


s19ZI Duty (as territorial authority) to take into account guidelines issued by the Commission in making certain determinations, etc. 
s28 Duty (as local authority) to give public notice of the right to demand a poll on the electoral system to be used for the elections of the local authority and its community boards. 
s35 Duty (as local authority) to conduct a poll using the electoral system specified. 
s36 Duty (as local authority) to use a particular voting method for elections and polls in the manner specified. 
s59 Duty (as local authority) in the circumstances prescribed, to pay forfeited deposits into the general fund and to return deposits. 
s118 Duty (as local authority/community board) to give public notice of resolution and selection process, where it resolves that a vacancy will be filled by appointment.



s119 Duty (as local authority/community board) to give public notice of resolution not to fill vacancy. 
s147 Duty (as local authority) to pay reasonable costs and expenses of conducting an election or poll in the circumstances specified.
