    1

    Summary of Function or Power

    Authority to exercise the powers and perform the duties of the Council under the Trespass Act 1980 as an occupier of all land owned, occupied or controlled by the Council;

    Power to nominate persons as occupiers of all land owned, occupied or controlled by the Council. 

     Restrictions:

    a. If a course of action is already provided by law in response to an action concerned, this must be followed rather than the issue a trespass notice.

    b. The Council must exercise the powers reasonably in the circumstances with particular reference to the rights and freedoms in the New Zealand Bill of Rights Act 1990.

    c.  Careful consideration must be given as to whether a trespass notice is reasonably necessary in the circumstances. 

    d. Particular restraint must be exercised where the place in question is a public place due to the potential impact on a person's rights and freedoms to have access to a library, swimming pools or reserve.
