Powers and duties (as local authority) with regard to updating, preparing and making the local governance statement available as specified.





Duty (as local authority) to undertake specified activities in accordance with Sch7: the status and conduct of members; meeting procedures for councils, community boards, and committees; powers of delegation; and the employment of staff.



Duties (as local authority) re consulting on a draft policy specified in subs(2) re inspection and information requirements.





Duty (as local authority) not to borrow or enter into incidental arrangements in currency other than NZ currency, other than investments.

Restriction: Delegation re borrowing extends only to borrowing made in accordance with the LTP and adopted policies.



Waive or remit costs associated with objection.

Power (as local authority) to apply to the District Court for an injunction restraining a person from committing a breach of a bylaw/offence against the Act subject to first obtaining legal advice.

Restriction: Subject also to General Delegations- Legal Proceedings



Remove or alter a work or thing that is, or has been, constructed in breach of a bylaw, and recover the costs of removal or alteration.

Return of property seized or impounded.

Dispose of property that has not been returned within six months after it was seized and impounded.

Enter any land or building other than a dwelling house.

Power of entry in case of emergency.

Issue warrant to enforcement officer.

Power to appoint enforcement officers under the Act.

Restriction: The power to appoint enforcement officers cannot be sub-delegated.

Contract out administration of regulatory functions.

Powers and duties (as territorial authority) in relation to requiring owner of land to remove/destroy matter considered likely to be a source of danger from fire; notification; court proceedings, entry onto land to undertake works, cost recovery etc, as specified.

Power (as territorial authority) to authorise officers to give oral notice requiring occupiers/owners of land to remove/destroy matter on land likely to be a source of danger from fire.







Reconsideration of requirement for development contribution.

Power to consider a request for the reconsideration of requirement for a development contribution in accordance with the Development and Contributions Policy and duty to provide notice of outcome to the applicant within the time period specified.

Power (as territorial authority) to apply for a judicial review of decision of development contributions commissioner.

Powers and duties (as territorial authority) re schedule of assets for which development contributions will be used, where it has been determined to seek funding for community facilities under Subpart 5 of Part 8 of the Act; content, making changes to the asset schedule; making information publicly available.

Powers and duties (as territorial authority) in relation to refunding a development contribution under the circumstances specified; power to retain part of contribution for costs incurred as described. 

Powers and duties (as territorial authority) in relation to refunding a development contribution if not applied for reserves purposes as specified; power to retain part of contribution for costs incurred as described.




Powers and duties (as territorial authority) re application to a District Court for order to require owner/occupier of any property to remove/alter a fence, structure or vegetation in accordance with Sch 14.

Restriction: Subject also to General Delegations – Legal Proceedings


Power (as local authority) to file a charging document re an offence under this Act, within the period specified.

Duties in relation to holding meetings

Duty (as shareholders of a CCO) to consult the board re notice of resolution to modify the statement of intent.
