Resource Management (Simplifying and Streamlining) Amendment Act 2009

Duty (as local authority/territorial authority/consent authority as applicable) to determine legal effect of a rule in a proposed plan/ a change notified before 1 October 2009 as if amendments of the Act had not been made. 

Duty (as territorial authority) where any of the actions specified have occurred prior to 1 October 2009, to determine a requirement for, or a requirement to alter, a designation or heritage order as if the amendments made by this Act had not been made. 

Duty (as consent authority) to determine that an application for a resource consent has lapsed in the circumstances specified, provided the application was made before 9 August 2005; Duty (as consent authority) to treat an application that is re-lodged after lapsing as described, as a new application. 

Duty (as local authority), where, prior to 1 October 2009, any matter specified has not proceeded to the stage at which no further appeal is possible, to determine the matter as if the amendments made by the Act had not been made.
