Consent for setting apart of Council held land for work of a network utility operator – (asset management)

Appealing to the Environment Court against a Heritage Protection Authority decision.

Alter heritage order (applies to both applications to and those by Council).

Power to authorise an officer to sign consent notice.

Power (as territorial authority) to authorise an officer to sign a certificate re the issue of a certificate of title for allotment of subdivided land as specified;

Power and duty (as territorial authority) to give the Registrar-General of Land a certificate signed by authorised officer confirming the matters specified;

Powers and duties (as territorial authority) re cancellation of such a covenant including endorsement of cancellation on survey plan and provision of certificate;

Power (as territorial authority) to authorise an officer to sign a certificate cancelling a covenant in whole or in part;

Duty (as territorial authority) to do all things necessary to effect registration of the certificate.

Powers and duties (as territorial authority) re cancellation of a condition in respect of separate allotments on a survey plan;

Power (as territorial authority) to authorise an officer to sign a certificate cancelling the condition in whole or in part; 

Duty (as territorial authority) to endorse memorandum of cancellation on survey plan and forward certificate to the Registrar- General of Land;

Power to do all things necessary to effect registration of the certificate.

 

Duty (as territorial authority) not to approve a survey plan that is subject to a condition that easements be granted, unless the memorandum specified is endorsed on the plan;

Power and duties (as territorial authority) re the revocation of the condition.

Power (as territorial authority) to authorise an officer to sign a certificate cancelling the condition in whole or in part.

Powers and duties (as consent authority) re approval of a plan of survey in respect of reclaimed land.

Duty (as local authority) where it has given notice of intention to appear, to attend a conference presided over by a member of the Environment Court, when so required and have one representative present with authority to make decisions on any matters as specified.
